All termsUnder Turkish law, pecuniary damages compensate in money the financial loss caused by a wrongful act or breach of contract. The loss may consist of an actual decrease in assets or of profits that would certainly have been earned but were missed.
Typical items include vehicle repair costs after a traffic accident, loss of earning capacity after a workplace injury, and funeral and treatment expenses in fatal cases. The injured party generally bears the burden of proving both the loss and the wrongdoer's fault; where the exact amount cannot be established, the judge determines it equitably based on the ordinary course of events.
Compensation may not enrich the victim: the actual loss is the ceiling. Contributory fault of the injured party, or benefits they derived from the event, may lead the judge to reduce the award.
