Ranking schedule of creditors

The ranking schedule is the list drawn up by the enforcement office when the sale proceeds of attached property cannot satisfy all creditors, showing each creditor's rank and share.

The order of priority is fixed by statute: secured claims are paid first out of the proceeds of the encumbered asset, followed by claims the statute designates as privileged and finally ordinary claims. Employees' claims for defined periods and maintenance claims enjoy privileged ranks. Creditors of the same rank share proportionately, and the rules on joining an attachment also affect the order.

The schedule is served on the interested parties. Challenges to the ranking are raised by complaint before the enforcement court, while challenges to the existence or amount of a claim require an action before the general courts, with deadlines running from service. Distribution does not take place until the challenges are resolved.
