A statutory right allowing consumers to walk away from certain contracts without giving any reason and without paying a penalty.
All termsUnder Turkish consumer law, the right of withdrawal allows a consumer to walk away from certain contracts without stating any reason and without paying a penalty. Its purpose is to let consumers reconsider decisions made under pressure or without seeing the goods.
The right applies most prominently to distance contracts such as online purchases, and also to off-premises contracts, timeshares and prepaid housing sales. The consumer must notify the seller within the statutory period, and the seller must then refund the payments received.
The right is not universal: exceptions listed in the legislation include custom-made goods, perishable items and unsealed hygiene products. If the seller fails to inform the consumer of this right, the withdrawal period is extended in the consumer's favour.
Sözleşmenin feshi ile karıştırılmamalıdır: fesih için genellikle haklı bir sebep aranır, cayma hakkı ise sebep gösterilmeden kullanılır.
